The W-8BEN form, explained for freelancers outside the US.
The W-8BEN is the one-page IRS form that tells a US payer you are not a US taxpayer. Upwork, Fiverr, Payoneer and US banks all ask freelancers outside America to keep one on file — and without it they may have to hold back up to 30% of US-source payments or freeze payouts. Ten minutes to submit, free forever, valid for about four years.
The form in one table.
Why platforms ask.
US companies paying people across borders have a rule to follow: under US tax law, certain US-source payments to a person whose foreign status is undocumented can require withholding of up to 30%. Platforms like Upwork and Fiverr collect thousands of such payments, so they make the W-8BEN part of their commission: submit tax information once, and the machine knows exactly which rules do not apply to you.
Here is the part that should lower your heart rate: when you perform the work from Ghana, Nigeria or Kenya, the money is foreign-source income, and US withholding generally does not touch it at all. The form is not a request for money — it is the paperwork that proves the withholding does not apply. It protects you. The 30% figure is what it stands between you and.
Treaty discounts — the part that makes many people nervous — mostly matter for passive income like royalties. There is no US income-tax treaty in force with Ghana, Nigeria or Kenya. Your work-in-exchange-for-payment from these countries is not treaty-dependent. That is why the form is as simple for you as it sounds: certify foreign status, keep it current, move on.
Filling it in, without fear.
Upwork and Fiverr both walk you through a digital version inside their settings — Upwork's Tax Information screen, Fiverr's withdrawal settings. No printing, no mailing, no fee. The paper fields translate to:
Your legal name, exactly as on your passport or national ID — not your brand name. Your country of citizenship — where you hold citizenship, not where your clients are. Your permanent home address — where you actually live, not your billing address. Part I's tax identification line — most freelancers enter their national tax or ID number (GRA TIN, KRA PIN, NIN); no US tax number is needed for the individual form. Date and electronic signature — a serious declaration under penalty of perjury, so say only what is true.
Submit one to each payer, keep the details identical everywhere, and note roughly when you signed it — the form runs until the end of the third succeeding calendar year, so a 2026 signature stays good until 31 December 2029. Re-file sooner only if something real changes: new address, new legal name, new country of residence.
Know your numbers, all of them.
The W-8BEN keeps US-side withholding at zero. The calculator keeps your rails cheaper than the default. Run your monthly billings and country through it — worst-case ranges across every route, and what each stage recovers.
Questions.
What is the W-8BEN form?
An IRS form called the Certificate of Foreign Status of Beneficial Owner. Freelancers who are not US persons sign it to tell a US payer — Upwork, Fiverr, a direct client, a bank — "my home country is not the United States, so apply the non-US withholding rules to my payments."
Do freelancers outside the US need a W-8BEN?
Yes, if a US-based platform or client pays you. Upwork and Fiverr collect it through their tax centres, and US banks and brokerages ask for it too. Each payer needs its own signed copy — one form does not cover them all.
What happens if I don't submit a W-8BEN?
Without a signed certificate on file, the payer's fallback is to treat you as an undocumented foreign payee, which can mean withholding of up to 30% on the US-source portion of your payments — or payouts frozen until the form is filed. Submitting it costs nothing and takes ten minutes.
Does the W-8BEN reduce my taxes?
Only if a US tax treaty with your country lowers a specific withholding rate — and no US income-tax treaty is in force with Ghana, Nigeria or Kenya. The good news is simpler: services you perform from Ghana, Nigeria or Kenya are foreign-source income, so US withholding generally does not apply to them at all — the form documents that, not a discount.
How long does a W-8BEN stay valid?
Through the end of the third succeeding calendar year after the year you sign it — sign in 2026 and it runs until 31 December 2029, unless a change in circumstances makes the information wrong. That is when you typically re-file: a new address, a new name, or a change in citizenship.
How do I submit a W-8BEN to Upwork or Fiverr?
Both platforms have a tax centre: Upwork's Tax Information screen and Fiverr's Withdrawal settings walk you through a digital W-8BEN you sign with a click. No printing, no mailing. Payoneer and other payout services each have their own equivalent — reflect the same details everywhere, because inconsistencies between forms are what trigger reviews.
W-8BEN vs W-8BEN-E — which one do I use?
W-8BEN is for individuals; W-8BEN-E is for entities — companies, LLCs, partnerships. A freelancer getting paid in their own name uses W-8BEN. Move to a registered company — like the US LLC route some freelancers take later — and you switch to the -E version, but a starter contract is always the plain individual form.
Does the W-8BEN affect my local taxes in Ghana, Nigeria or Kenya?
No. It is a US-side document only. You still owe your own income tax at home — GRA, FIRS or KRA rules apply to the same money. What the form does is stop the payer from guessing about the US side. What it never does is exempt you from your own country's tax — register, declare, stay clean.
